Supreme Court asked to block noncitizens from voting in U.S. elections
Limiting only American citizens to voting in American elections should not at all be controversial.
However, Democrats are strangely determined to permit noncitizens to participate in American elections.
A group of 24 states asked the Supreme Court to rule that noncitizens do not have the right to the franchise.
The states filed a brief that backed an Arizona law requiring proof of citizenship in order to vote.
In 2022, Arizona passed a law that required all voters to present documents in order to prove citizenship to be able to vote.
Far-left activist group Mi Familia Vota sued to stop the law by claiming that the National Voter Registration Act precludes a state from implementing a citizenship requirement.
Florida Attorney General Ashley Moody wrote in the brief that the threat of noncitizens voting in U.S. elections is very real.
Moody wrote, “However, courts have chipped away at the states’ authority to secure their own elections . . . Voting by noncitizens, both legal and illegal, is real. The typical rejoinder is to claim that few noncitizens vote. On its own terms, though, the answer at least acknowledges that the problem persists. But it also ignores that even small voting blocs can have outsized effects on electoral outcomes. That effect is most obvious in local elections.”
The brief argued that the National Voter Registration Act did not supersede state law.
Republican attorneys general that signed onto the brief represented Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Iowa, Indiana, Kansas, Kentucky, Louisiana, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, Virginia, and West Virginia.
One concern was the unprecedented levels of illegal immigration into the country under Joe Biden and Kamala Harris’ watch.
The brief stated, “There is every reason to believe this problem of non-citizen voting has gotten worse, as the number of illegal immigrants in the United States has undeniably grown . . . Each of those illegal aliens represents another possible opening for voter fraud, for each represents a probability – no matter how small – that they will vote illegally.”
Supreme Court hands down a partial victory for election integrity
The Supreme Court handed down a 5-4 ruling that allowed Arizona to enforce parts of its law requiring proof of citizenship in order to vote after an emergency request from the Republican National Committee (RNC).
Arizona officials are permitted to require proof of citizenship when a standard voter registration form is submitted.
However, the proof of citizenship cannot be required for mail voting or for Presidential voting.
Republican National Committee chairman Michael Whatley said that the ruling was a “seismic win in the fight to stop non-citizens from voting.”
The legal fight continues regarding the law.
A three-judge panel with the Ninth Circuit Court of Appeals is hearing an appeal of a lower court ruling blocking the law from being enacted.
Everything is so upside-down, it will take a brutal legal fight simply to enforce what should be obvious for a democratic republic.
